ACQUISTO PRIMA CASA AL FIGLIO – STRUMENTI E METODI OPERATIVI
E’ noto come oggi la principale fonte di finanziamento per un giovane sia il proprio genitore, in quanto la precaria condizione lavorativa pone delle difficoltà di accesso al credito bancario.
Tant’è che la generale situazione economica attuale spinge molti genitori ad aiutare i propri figli nell’acquistare casa. L’aiuto dei genitori può essere
- diretto, mettendo a disposizione dei figli, in tutto o in parte, le risorse finanziarie necessarie all’acquisto didi casa;
- indiretto, offrendosi come garanti presso la banca per il mutuo.
A fronte di una importante decisione, quale quella dell’acquisto della prima casa, non può non tenersi in debito conto di eventuali problematiche che potrebbero insorgere anche con il fisco (Ad illustrare le possibilità che oggi hanno i genitori che vogliano aiutare i figli a comprare casa è il Consiglio Notarile di Milano nel secondo incontro del ciclo “Comprar casa senza rischi”).
Le soluzioni che oggi hanno i genitori per aiutare i figli nell’acquisto di casa sono sostanzialmente due:
- effettuare una donazione in denaro ai figli affinchè poi questi ultimi effettuino il pagamento del prezzo della casa
- pagare totalmente o in misura parziale il prezzo dovuto per l’acquisto dell’abitazione, senza che il denaro transiti dai conti correnti dei genitori a quello dei figli.
Nel primo caso vi sono un passaggio di denaro e due atti notarili da stipulare:
- il primo la donazione del denaro che deve essere conclusa per atto pubblico dinanzi ad un notaio, a pena di nullità;
- il secondo atto è la compravendita della casa il cui prezzo è versato dai figli con il denaro ricevuto dai genitori.
La seconda soluzione, ossia il pagamento del prezzo della casa direttamente da parte dei genitori, senza donare denaro ai figli, è ovviamente la più veloce in quanto c’è bisogno di un solo atto notarile, ossia la compravendita immobiliare in cui si potrà specificare che il prezzo, in tutto o in parte, è stato pagato al venditore direttamente dai genitori. La scelta tra l’una e l’altra soluzione dipende dalla propria situazione personale, ma è necessario conoscere vantaggi e svantaggi di entrambe.
- Nel caso della donazione del denaro dai genitori ai figli i vantaggi sono in primo luogo la chiarezza e trasparenza dell’operazione sia nei rapporti familiari, specie se vi siano altri figli, sia rispetto ad eventuali controlli che potrà effettuare in un secondo momento l’Agenzia delle Entrate. L’atto di compravendita inoltre è lineare e facilita la successiva vendita della casa qualora i figli decidano in futuro di cambiare abitazione. Inoltre dal punto di vista fiscale si sottolinea che se la donazione in denaro è fino a € 1.000.000 per ciascun genitore e per ciascun figlio non comporta il pagamento dell’imposta di donazione.
Quali sono gli svantaggi?
Ovviamente sono necessari due atti notarili e quindi un aumento dei costi. Inoltre la donazione di denaro, pur non comportando pagamenti di imposta se di importo inferiore a euro 1.000.000 per ciascun genitore e per ciascun figlio, erode comunque la franchigia applicabile alla futura successione.
- Nel caso del pagamento del prezzo della compravendita direttamente dai genitori al venditore senza il transito di denaro ai figli, ha come vantaggio principale la velocità dell’operazione quindi meno costi. Il pagamento del prezzo, ove costituisca una liberalità in favore dei figli, inoltre è completamente esente da imposta di donazione e successione e non erode la franchigia di euro 1.000.000 che resta pertanto integra per l’intero importo. Infine se l’atto è ben scritto, è comunque garantita la chiarezza e la trasparenza dell’operazione, sia nei rapporti famigliari (specialmente se vi sono altri figli), sia rispetto a eventuali verifiche da parte dell’Agenzia delle Entrate a carico dell’acquirente in ordine alla provenienza del denaro impiegato nell’acquisto.
Lo svantaggio principale per chi sceglie questa opzione è che l’atto di compravendita possa in qualche modo complicare la successiva rivendita della casa e nel caso in cui ometta o non sia chiaro che sono stati i genitori a pagare in tutto o in parte il prezzo dovuto al venditore, potrebbero essere pregiudicati i rapporti famigliari (soprattutto se vi sono altri figli), ma anche eventuali controlli dell’Agenzia delle Entrate in merito alla provenienza del denaro impiegato nell’acquisto.
